  • What is a monument builder?

    A monument establishment that maintains a full-service place of business at a specific street address or location in Florida, in compliance with zoning regulations of local government and not located on tax-exempt property. This establishment includes an office to conduct of business and the receive customers. There is a display area with monuments, markers and related products for inspection by customers prior to sale. The office and display area are normally open to the public weekdays during normal business hours. There will be facilities on site for inscribing monuments and equipment to deliver and install markers and monuments.

     

  • What is a monument retailer?

    A monument establishment that maintains a physical structure that is located at a specific street address or location in Florida, in compliance with zoning regulations of local government and not located on tax-exempt property. This establishment is not required to comply with office and display area requirements or have facilities on site for inscribing monuments and equipment to deliver markers and monuments.

     

  • What is the advantage of being a monument builder?

    A monument builder is eligible to become a member of the Board of Funeral, Cemetery and Consumer Services.

    A monument builder can sell pre-need monument merchandise.

    If applying between October 1 of an odd year to September 30 of an even year the initial total license cost is $405. If applying between October 1 of an even year to September 30 of an odd year the initial total license cost is $305.

    The initial application fee is $205 for either the first or 2nd year.

     

  • What is the renewal application fee for a monument builder?

    A renewal license is for a biennal period beginning October 1 of an odd year. The cost is $405 per biennal period.

    A renewal license is for a biennal period beginning October 1 of an odd year. The cost is $205 per biennal period.

     

  • Are statutory inspections of monument builders required?

    No

     

  • Is there a charge for statutory annual inspections?

    Monument builders must pay $100 per year for statutory annual inspections. This is part of the initial and renewal license fees.

    Monument retailers are not required to have statutory annual inspections.

     

  • Are for-cause inspections of monument builders or monument retailers allowed?

    Yes. Monument builders and monument retailers must submit to for-cause inspections as needed.

     

  • Are monument builders and monument retailers required to have their sales agreements approved by the Board of Funeral, Cemetery and Consumer Services?

    Yes. Monument builders are required to submit their agreements for at-need and pre-need merchandise sales to the Board of Funeral, Cemetery and Consumer Services for approval.

  • What must be included in a sales agreement?

    A complete description of any monument, marker or related product to be delivered and shall prominently and clearly display the agreed date for delivery and installation.

     

  • What if a monument establishment fails to deliver and install a purchased monument or marker by the date agreed in the sales agreement?

    A full refund of all amounts paid by the customer is required within 30 days after receipt by the monument establishment of a customer written request for a refund unless the monument establishment has obtained a written agreement from the customer extending the delivery date. This does not preclude the purchase and installation of a new monument from any other registered monument establishment or licensee.

     

  • Are monument establishments responsible for handling customer complaints?

    Yes. Monument establishments must have written procedures for the receipt, investigation, and disposition of customer complaints and ensure that their staff who receive or process customer complaints are familiar with and follow the procedures.

     

  • Should monument establishments have a consumer complaints log?

    All monument establishments should maintain for inspection by the Department records of written complaints received by the monument establishment. The complaint records should include a chronological log of written complaints received, in which the name and address of each complainant and date of complaint is entered consecutively within 10 business days of receipt of each complaint. The original or complete copy of each written complaint received by the monument establishment and all subsequent correspondence related to such complaint shall be maintained by the monument establishment, for inspection by the Department, for the longer of 24 months or 12 months after the most recent Department inspection during which the complaint was in the monument establishment’s complaint records and available for the Department’s review.

     

  • Who may apply for a monument builder or retailer license?

    A natural person at least 18 years of age, a corporation, partnership or a limited liability company.

    The applicant must provide their name and address and the name and address of all principles of the applicant. The applicant’s social security number or federal tax identification number is required. The applicant must disclose financial resources; criminal records; and for the applicant or any principle, must disclose any license or the authority to practice a profession or occupation that has been revoked, suspended, fined or denied.

    The applicant must submit fingerprints through the state contractor IBT. Appointment arrangements are made on this web site.

     

  • Are monument builder or retailer licenses transferable or assignable?

    No.

     

  • Change of ownership requirements.

    Promptly report the change in ownership to the Division of Funeral, Cemetery and Consumer Services. Submit a new application with application fees. A new inspection of the establishment is required.

     

  • Change in location requirements.

    Promptly report the planned change in location to the Division of Funeral, Cemetery and Consumer Services. Operations at the new location may not begin until an inspection of the new location is satisfactorily completed.

     

  • Who may not qualify for a monument establishment license?

    An applicant that did not pay the required application fee.

    An applicant that does not have the required facilities.

    An applicant that would pose an unreasonable risk to the public because of lack of experience, or lack of financial resources or the criminal or disciplinary record of the applicant or its principles, or has a history of violations of Florida laws by the applicant of principles regarding funeral or cemetery or other business activities or has a history of lack of trustworthiness or integrity on the part of the applicant or its principles.

     

  • Who is a monument establishment sales agent?

    A person selling monuments, markers or related products for a monument establishment.

     

  • Are monument establishment sales agents required to be licensed?

    Monument establishment sales agents are required to be licensed as a monument establishment sales agent unless they are already licensed or registered in another capacity in Chapter 497, Florida Statutes.

     

  • What is the initial application fee for a monument establishment sales agent?

    $55 for a biennal license that will expire on September 30, of an odd year.

     

  • What is the renewal application fee for a monument establishment sales agent?

    $55 for a biennal license this is effective October 1, of an odd year.

     

  • Can a monument establishment sales agent’s authority be terminated?

    Yes. The monument establishment officer that signed the sales agent application may terminate the agent’s authority. The monument establishment shall advise the Division of Funeral, Cemetery and Consumer Services in writing within 30 days after the termination.

     

  • Who is responsible for monument establishment sales agents?

    The sponsoring monument establishment supervises the activities of the sales agents.
